Detroit Area Consumer Bankruptcy Attorneys
A variety of forces and circumstances have made Chapter 13 bankruptcy filings more common than in the past. Many people who are ineligible for Chapter 7 bankruptcy because of their income level, or who face other unique circumstances, decide to pursue some debt relief and “reorganize” other obligations with this approach.
We have successfully filed many Chapter 13 bankruptcy cases in Southeast Michigan, each with the honesty, compassion and personal service required by our client. Please contact our Southfield/Mt. Clemens, Michigan, law offices today for a free, informative telephone consultation to talk about your situation.
A Plan That Enables You To Pay Debt Over Time, Without Interest
In Chapter 13 “wage earner” bankruptcy, we must file a detailed plan with the court, and you will commit to making monthly payments over a period of time. Some debt may be forgiven, but you will be required to pay priority debts such as tax debt or back child support in full, as well as — in most cases — some portion of what you owe unsecured creditors. However, payments are based on what you can reasonably afford, and you stop interest from accruing so you can catch up.
As you can see, this is a major commitment, but it may be the best solution available if, to cite just a few examples, you:
- Earn a decent income but are overwhelmed by credit card payments or other unsecured debt, often impairing your ability to meet other essential obligations
- Face home mortgage foreclosure and want to exhaust all options to protect your equity or the home itself
- Have substantial tax debt incurred within the last several years
Chapter 13 bankruptcy enables many people to regain financial stability and protect critical assets. It provides some of the same very important benefits as filing Chapter 7, such as an automatic stay that ends creditor harassment and prevents judgments and garnishments.
